A rat was scurrying across the bathroom floor.<\/p>\n\n\n\n<p>\u201cI grabbed the kids and ran out of the house,\u201d she said.&nbsp;<\/p>\n\n\n\n<p>Jackson said that was the day she knew she and her three young children could no longer live in Chickasaw, a small suburb just outside Mobile. The rats, she knew, were likely a result of the trash piling up in the carport adjacent to her rented home. But there was little Jackson felt she could do to fix the root problem.<\/p>\n\n\n\n<p>The city wouldn\u2019t pick up her trash. And it had charged her with \u201ctheft of service\u201d over monthly garbage bills she couldn\u2019t pay.&nbsp;<\/p>\n\n\n\n<p>Jackson\u2019s case is one of more than 180 incidents where Chickasaw residents have been criminally charged over past-due garbage bills since city leaders <a href=\"https:\/\/www.scribd.com\/document\/770648327\/Chickasaw-Alabama-s-Theft-of-Utility-Services-Ordinance\">passed an ordinance<\/a> allowing the practice in March 2021. The ordinance provides a mechanism for city officials to issue a criminal summons or arrest a resident who falls behind on bills for garbage or sewer\u2014the most basic municipal environmental services\u2014provided by the city\u2019s utilities board. Monthly garbage fees in Chickasaw are $20 and sewer fees are $50. The tab mounts quickly when people get behind\u2014and city policy does not allow them to make partial payments to start catching up.<\/p>\n\n\n\n<p>An investigation by Inside Climate News that included interviews with more than a dozen impacted residents and an analysis of court records shows that the ordinance\u2014passed by an all-white city council\u2014disproportionately harms women and Black residents. People facing disabilities, the analyses found, are also affected by the city\u2019s policy.&nbsp;<\/p>\n\n\n\n<p>Legal experts with the <a href=\"https:\/\/www.splcenter.org\/about\">Southern Poverty Law Center<\/a> who reviewed Chickasaw\u2019s municipal court documents say the town\u2019s practice of prosecuting its citizens over unpaid bills violates both state and federal law. In a letter sent to Chickasaw\u2019s city attorney on Sept. 11, lawyers for the organization demanded that the city rescind its ordinance and halt the practice of taking residents\u2019 garbage cans over nonpayment.&nbsp;<\/p>\n\n\n\n<p>\u201cOur review of the City\u2019s billing practices, its theft of service ordinance, nearly 200 criminal case files, and conversations with dozens of Chickasaw residents indicate that the City\u2019s practices violate multiple constitutional provisions and state and federal laws,\u201d the letter said.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img decoding=\"async\" width=\"2500\" height=\"1667\" src=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/Chickasaw-3_Credit-Lee-Hedgepeth.jpg\" alt=\"Chickasaw was founded as a company town in the first half of the 20th century. Micah West, an attorney for the SPLC, said the anti-poverty nonprofit has not yet received a response to its letter.&nbsp;<\/p>\n\n\n\n<p>Both Alabama and federal law prohibit jailing residents over debts, according to legal experts.&nbsp;<\/p>\n\n\n\n<p>Alabama\u2019s Constitution, for example, provides \u201cthat no person shall be imprisoned for debt.\u201d An Alabama Attorney General\u2019s Office opinion from 1990 also addressed the issue of utility bill debt, concluding that \u201ca municipality may not penalize those who fail to pay their garbage fee.\u201d Alabama law also includes a mechanism for cities and other local governments to waive fees for elderly residents facing financial hardship.&nbsp;<\/p>\n\n\n\n<p>Even so, this isn\u2019t the first time an Alabama community has criminally charged a citizen over garbage bills. In 2022, the city of Valley garnered national headlines after its police officers <a href=\"https:\/\/www.cbs42.com\/digital-exclusive\/you-ought-to-be-ashamed-82-year-old-alabama-woman-says-arrest-over-77-trash-bill-was-unjust-unnecessary\/\">arrested 82-year-old Martha Menefield<\/a> for failure to pay a $77 trash bill, placing her in handcuffs at her own home. Soon, <a href=\"https:\/\/www.cbs42.com\/digital-exclusive\/trash-valley-how-an-alabama-towns-garbage-policy-left-its-citizens-in-cuffs\/\">dozens of similar cases within Valley<\/a> were brought to light. After intervention from lawyers at SPLC and other organizations, the local district attorney agreed to end the practice.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-full is-style-multiply\"><img decoding=\"async\" width=\"700\" height=\"703\" src=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/AlabamaGarbage.png\" alt=\"\" class=\"wp-image-86488\" srcset=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/AlabamaGarbage.png 700w, https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/AlabamaGarbage-300x300.png 300w, https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/AlabamaGarbage-150x150.png 150w, https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/AlabamaGarbage-64x64.png 64w\" sizes=\"(max-width: 700px) 100vw, 700px\" \/><\/figure>\n\n\n\n<p>Now, though, West is concerned that the criminalization of getting behind on utility bills may be more common than experts previously realized. Inside Climate News found cases in at least three other places.<\/p>\n\n\n\n<p>\u201cWe can see now in Chickasaw that Valley was not an isolated incident,\u201d he said. \u201cWe think that cities throughout the state of Alabama are prosecuting people who fall behind on their garbage bills.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">\u2018<strong>There Was a Blind Man There\u2019<\/strong><\/h2>\n\n\n\n<p>On a Sunday earlier this month, Jose Young stepped out onto his front porch to talk. Behind him, a crimson University of Alabama \u201cA\u201d hung on the door. Young wore casual clothes\u2014a T-shirt and some basketball shorts. He was sorry he wasn\u2019t dressed better, he said, but he\u2019s been suffering from phantom pains, an ongoing challenge stemming from an injury after he was run over years ago, leaving the Black man with an amputated leg and other physical disabilities.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is crazy,\u201d Young said of his situation with the city, even before he began to explain it in earnest. \u201cIt\u2019s all crazy.\u201d&nbsp;<\/p>\n\n\n\n<p>Young said his garbage problems began when his fianc\u00e9e was diagnosed with cancer and had to quit her job. That change left the family struggling to make ends meet.<\/p>\n\n\n\n<p>Soon, the couple attempted to pay what they could to begin catching up on their utilities, which then amounted to a couple hundred dollars. Then came the roadblock. Partial payments would not be accepted, city officials told Young, he said. So the unpaid bill, now with additional late fees, kept adding up. Credit: Lee Hedgepeth\/Inside Climate News<\/figcaption><\/figure>\n\n\n\n<p>\u201cAll bills with a $125 balance or more are DUE IMMEDIATELY or Services will be Disconnected,\u201d Chickasaw\u2019s utility bills state. \u201cIf services are disconnected, additional late fees and reconnection fees will apply and must be paid, in full, along with the balance on the account before services can be reconnected. \u2026 We do not make payment arrangements.\u201d<\/p>\n\n\n\n<p>It wasn\u2019t long before Young received a criminal summons in the mail, requiring him to appear before a judge or face a warrant for failure to appear.&nbsp;<\/p>\n\n\n\n<p>Young said he explained his situation to the judge. He felt unheard.&nbsp;<\/p>\n\n\n\n<p>\u201cI\u2019ve never seen a place where you couldn\u2019t make partial payments,\u201d he said. \u201cThat was crazy to me.\u201d<\/p>\n\n\n\n<p>Young said that when he went to his appointed court hearing, the courtroom was full of others in similar situations.&nbsp;<\/p>\n\n\n\n<p>\u201cThere was a blind man there,\u201d Young said. \u201cThey had to help him up to the bench and everything. I thought, \u2018Jesus Christ.\u2019\u201d<\/p>\n\n\n\n<p>He believes that inability to pay a bill should never land you in jail.&nbsp;<\/p>\n\n\n\n<p>\u201cIf I was illegally dumping trash or dumping something toxic, that may be a crime,\u201d he said. \u201cBut this? It\u2019s crazy. I\u2019m 51 years old, and I never had a criminal record until this.\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2018I Just Couldn\u2019t Pay That Much\u2019<\/strong><\/h2>\n\n\n\n<p>Shaquala Jackson said she\u2019ll never go back to Chickasaw. She\u2019d moved there in 2021 when a fellow church member offered her a property that accepted funding from Section 8, a housing assistance program.&nbsp;<\/p>\n\n\n\n<p>The garbage problems began when Jackson, a Black mother of three, received a notice that the bill had not been paid. Jackson said she\u2019d been told upon moving in that the utilities were to be included in the rent. Jackson contacted the landlord, who assured her that the issue would be resolved. Soon, though, Jackson\u2019s trash can was taken and she received another bill. An employee told her the bill was her responsibility and they did not accept partial payments.&nbsp;<\/p>\n\n\n\n<p>\u201cI just couldn\u2019t pay that much,\u201d Jackson said. \u201cNot all at one time.\u201d<\/p>\n\n\n\n<p>So Jackson&#8217;s trash began to pile up in the carport just outside her home. Three young children, she said, produce more trash than you realize.<\/p>\n\n\n\n<p>The last straw came when her three-year-old screamed in the bathroom.<\/p>\n\n\n\n<p>\u201cIt\u2019s a big cock-a-roach,\u201d her daughter yelled.&nbsp;<\/p>\n\n\n\n<p>Jackson soon realized it was no cockroach. It was a rat, something her daughter had never seen before.&nbsp;<\/p>\n\n\n\n<p>She got her children out and soon left Chickasaw for good.&nbsp;<\/p>\n\n\n\n<p>Jackson said her children are traumatized by that memory.&nbsp;<\/p>\n\n\n\n<p>\u201cThey\u2019re still terrified,\u201d she said. \u201cEvery place we move to now, they ask, \u2018Are we going to see a rat? Are the rats going to eat us?\u2019\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2018It Felt Like Extortion\u2019<\/strong><\/h2>\n\n\n\n<p>Kelia Coleman, a Black mother of five boys, said she spends every day in fear of losing her freedom and her ability to take care of her children.<\/p>\n\n\n\n<p>Each time a police cruiser passes by her home, she\u2019s reminded of the criminal charge hanging over her head\u2014theft of utility services\u2014in the wake of what she says has been a nightmare of a misunderstanding. She doesn\u2019t know whether or when a judge will issue a warrant for her arrest over her outstanding garbage bill.&nbsp;<\/p>\n\n\n\n<p>Coleman\u2019s family moved to Chickasaw about four years ago from Mobile. When they moved in, she and her husband contacted the city about beginning garbage services, which she believed would be bundled with her water service as it had been at her previous home.&nbsp;<\/p>\n\n\n\n<p>Only years later did Coleman find out that her family\u2019s trash fees had gone unpaid and unbilled, she said, increasing to over $1,000. When Coleman reached out to begin paying off the balance, she said she was told that partial payments were not acceptable.&nbsp;<\/p>\n\n\n\n<p>\u201cI did not have $1,000 to pay them all at once,\u201d Coleman told Inside Climate News.&nbsp;<\/p>\n\n\n\n<p>Around 44 percent of Americans say they don\u2019t have enough savings to pay an unexpected $1,000 expense, <a href=\"https:\/\/www.cnbc.com\/2024\/01\/24\/many-americans-cannot-pay-for-an-unexpected-1000-expense-heres-why.html\">according to recent survey data<\/a>. In Chickasaw, the problem is even worse, with nearly a third of residents living below the federal poverty line, according to census data\u2014a rate more than double the national average.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/Chickasaw-16_Credit-Lee-Hedgepeth-1024x683.jpg\" alt=\"Residents without trash cans often haul off trash to nearby dumpsters or loved ones' homes. Her husband began hauling it away when he could, paying to drop the trash off in neighboring majority-Black Prichard\u2019s public-access landfill. But it\u2019s hard to keep up.&nbsp;<\/p>\n\n\n\n<p>\u201cIt\u2019s too much,\u201d Coleman said. \u201cIt\u2019s very hard for us with five small sons and no garbage pickup.\u201d<\/p>\n\n\n\n<p>After the trash began to accumulate, enforcement officials told Coleman that if the garbage wasn\u2019t cleaned up, she would be fined. Infuriated, Coleman said she again demanded a payment plan. City officials relented, she said, but told her she still wouldn\u2019t receive a garbage can until the full unpaid balance was resolved.<\/p>\n\n\n\n<p>\u201cMy mouth dropped,\u201d she said. \u201cIt felt like extortion.\u201d<\/p>\n\n\n\n<p>On top of the practical problem of garbage service, Coleman said the criminalization of her debt has left her mentally paralyzed and frightened her children.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cI try so hard, and Chickasaw just always finds a way to knock us down.\u201d<\/p>\n<cite>\u2014 Kelia Coleman<\/cite><\/blockquote>\n\n\n\n<p>\u201cThey are threatening to lock me up and take me away from my kids for not paying something that I don\u2019t have instead of working with me on it,\u201d she said. \u201cIt\u2019s gotten to the point where my kids are terrified of police and have full-on anxiety attacks when they see them coming.\u201d&nbsp;<\/p>\n\n\n\n<p>The situation has left Coleman depressed much of the time, overwhelmed with the trash and the fear of jail.&nbsp;<\/p>\n\n\n\n<p>\u201cI try so hard, and Chickasaw just always finds a way to knock us down,\u201d Coleman said.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>The Role of Race<\/strong><\/h2>\n\n\n\n<p>Chickasaw\u2019s municipal court records demonstrate that Jackson and Coleman\u2019s experience as Black women isn\u2019t unique in the town of just under 6,500 people.&nbsp;<\/p>\n\n\n\n<p>An Inside Climate News review of court records confirms that women and, in particular, Black women are arrested over nonpayment of garbage fees more than other demographic groups. Black women comprise just 25 percent of the town\u2019s population but account for around 37 percent of trash prosecutions. Women as a whole are also more frequently charged under Chickasaw\u2019s theft of service ordinance. While they make up about half of the town\u2019s population, women constitute more than 61 percent of those charged.&nbsp;<\/p>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe title=\"In Chickasaw, women are criminally charged more often than men over unpaid garbage bills\" aria-label=\"Multiple Pies\" id=\"datawrapper-chart-6cdqB\" src=\"https:\/\/datawrapper.dwcdn.net\/6cdqB\/1\/\" scrolling=\"no\" frameborder=\"0\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"380\" data-external=\"1\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(a){if(void 0!==a.data[\"datawrapper-height\"]){var e=document.querySelectorAll(\"iframe\");for(var t in a.data[\"datawrapper-height\"])for(var r=0;r<e.length;r++)if(e[r].contentWindow===a.source){var i=a.data[\"datawrapper-height\"][t]+\"px\";e[r].style.height=i}}}))}();\n<\/script>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>Jackson said she\u2019s not surprised that race plays a role in the way Chickasaw treats its residents.&nbsp;<\/p>\n\n\n\n<p>\u201cI was always told that Chickasaw was a \u2018No Black Zone\u2019 for many years,\u201d she said. \u201cSo maybe they just want to get the Black people out of \u2018their\u2019 area.\u201d<\/p>\n\n\n\n<p>Chickasaw began as a company town in the first half of the 20th century, housing white workers\u2014and only white workers\u2014for local shipbuilders in the modest houses along its narrow gridded streets.<\/p>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<iframe title=\"Black women in particular are disproportionately charged over late trash fees\" aria-label=\"Multiple Pies\" id=\"datawrapper-chart-j5w8t\" src=\"https:\/\/datawrapper.dwcdn.net\/j5w8t\/1\/\" scrolling=\"no\" frameborder=\"0\" style=\"width: 0; min-width: 100% !important; border: none;\" height=\"368\" data-external=\"1\"><\/iframe><script type=\"text\/javascript\">!function(){\"use strict\";window.addEventListener(\"message\",(function(a){if(void 0!==a.data[\"datawrapper-height\"]){var e=document.querySelectorAll(\"iframe\");for(var t in a.data[\"datawrapper-height\"])for(var r=0;r<e.length;r++)if(e[r].contentWindow===a.source){var i=a.data[\"datawrapper-height\"][t]+\"px\";e[r].style.height=i}}}))}();\n<\/script>\n\n\n\n<div style=\"height:22px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p>By 1980, despite advances in racial integration in other parts of the country, Chickasaw remained an all-white, exclusive enclave. That year, for example, <a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/504\/716\/2153760\/\">a federal judge ruled<\/a> that the city and its housing authority had illegally barred African Americans from public housing through the adoption of a Chickasaw citizenship requirement that one public official said would keep neighboring, majority-Black Mobile from using Chickasaw\u2019s public housing as what he termed a \u201cdumping ground for social undesirables.\u201d At that point, <a href=\"https:\/\/law.justia.com\/cases\/federal\/district-courts\/FSupp\/504\/716\/2153760\/\">the court found,<\/a> local officials knew \u201cthe City of Chickasaw had a reputation as a Caucasian town and that no Negroes had lived in Chickasaw since World War II.\u201d<\/p>\n\n\n\n<p>In the decades since that suit, Chickasaw has seen Black residency within its limits climb substantially. Now, more African Americans live in Chickasaw (around 49 percent of the total population) than whites (about 44 percent of residents). Despite that change in the city\u2019s demographics, its political leadership has remained largely the same. Today, all of Chickasaw\u2019s city councilors are white, as is its mayor.&nbsp;<\/p>\n\n\n\n<p>Jackson said she thinks the town\u2019s history is baked into its present. She hopes, though, that city leaders will step up and do what she says is right: ending the prosecution of its citizens, Black and white, over an inability to pay for trash service.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Cuffed Over Garbage<\/strong><\/h2>\n\n\n\n<p>Joseph Uptagraft thought it must be some kind of confusion.&nbsp;<\/p>\n\n\n\n<p>Uptagraft, a white mechanic and father of four, was working at his shop in Theodore when his wife called. He couldn\u2019t believe what she told him.<\/p>\n\n\n\n<p>\u201cPolice officers had come up to my house and told my wife that they had a warrant for my arrest,\u201d he said. Uptagraft left work and went straight to the police department, where he was told he was being arrested for theft of utility over a past-due garbage bill that Uptagraft said he\u2019d simply overlooked. The bill had accumulated to over $1,000 including late fees, he was told. Uptagraft said he\u2019d never been served with any summons to notify him of a court date.&nbsp;<\/p>\n\n\n\n<p>\u201cThey put cuffs on me behind my back,\u201d he said. Uptagraft was transferred to nearby Saraland, then to Mobile Metro Jail, where he was booked and spent several hours before being released.&nbsp;<\/p>\n\n\n\n<p>Chickasaw\u2019s statute provides options of fines, jail time or both for those convicted of theft of utility service. It also provides the government with the option of either simply summoning an alleged offender to criminal court or, based on the \u201camount and severity of alleged violations,\u201d arresting them, according to the statute\u2019s text.&nbsp;<\/p>\n\n\n\n<p>\u201cThat\u2019s a hell of a way to tell somebody they\u2019re past due on their bill,\u201d Uptagraft said of the arrest. \u201cHow do they think someone in jail will manage to get it caught up?\u201d<\/p>\n\n\n\n<p>Uptagraft said he\u2019s sickened by what he views as hypocrisy among those who have served city leadership.<\/p>\n\n\n\n<figure class=\"wp-block-image alignwide size-full\"><img decoding=\"async\" width=\"2500\" height=\"1667\" src=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/Chickasaw-2_Credit-Lee-Hedgepeth.jpg\" alt=\"A view of Chickasaw's city complex, topped with a Chieftain weather vane. Credit: Lee Hedgepeth\/Inside Climate News<\/figcaption><\/figure>\n\n\n\n<p>In 2012, water service to Chickasaw City Hall <a href=\"https:\/\/www.al.com\/live\/2012\/04\/prichard_cuts_off_water_to_chi.html\">was turned off<\/a> by Prichard water officials after Chickasaw officials refused to pay a $24,000 water bill.&nbsp;<\/p>\n\n\n\n<p>\u201cThey can\u2019t charge us with theft of services when they\u2019ve done the same thing,\u201d Uptagraft said.&nbsp;<\/p>\n\n\n\n<p>He also pointed to a recent fine issued to the city by the Alabama Department of Environmental Management over an open burn of trash. Following a citizen complaint, state regulators said they found city workers had conducted <a href=\"https:\/\/mynbc15.com\/newsletter-daily\/city-of-chickasaw-faces-fine-for-burning-waste-on-city-property\">an open burn<\/a> of \u201camong other things, tire, appliances, electronics and garbage on the Lagoon Road property.\u201d ADEM fined the city $5,000 over the incident.&nbsp;<\/p>\n\n\n\n<p>\u201cADEM got onto them and fined them,\u201d Uptagraft said. \u201cSo they go after us, but do they think they\u2019re above the law?\u201d<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>\u2018I Wouldn\u2019t Plead Guilty\u2019<\/strong><\/h2>\n\n\n\n<p>Barbara Lowell was 44 years old when she broke her neck swimming at Orange Beach. Since then, she said, she\u2019s been living on a fixed income, using the Social Security Disability checks of a few hundred dollars she receives each month to meet her basic needs.&nbsp;<\/p>\n\n\n\n<p>Lowell, a white woman, said she\u2019s always struggled to pay her city utility bill, which includes charges for garbage and sewer, but the real issues began when she missed a couple of months\u2019 payments of around $70.&nbsp;<\/p>\n\n\n\n<p>\u201cThey don\u2019t take partial payments, so you have to pay in full,\u201d she said. \u201cAnd I just couldn\u2019t do that.\u201d&nbsp;<\/p>\n\n\n\n<p>Following Lowell\u2019s missed payments, either city officials or garbage workers took her trash can, leaving the resident with nowhere to place her garbage. Lowell said that she soon received a notice to appear in criminal court, where she said she was advised to plead guilty in order to receive a payment plan. Lowell refused.<\/p>\n\n\n\n<p>\u201cThey wouldn\u2019t work out a plan or anything because I wouldn\u2019t plead guilty,\u201d she said.&nbsp;<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>\u201cThey don\u2019t take partial payments, so you have to pay in full. And I just couldn\u2019t do that.\u201d\u00a0<\/p>\n<cite>\u2014 Barbara Lowell<\/cite><\/blockquote>\n\n\n\n<p>In the case of Valley, which was also issuing criminal charges for unpaid trash fees, impacted residents filed a class action lawsuit against the city and its garbage contractor. Plaintiffs alleged that the criminalization of unpaid garbage bills was effectively a racket, with the local government acting as the enforcer of a private company\u2019s interest.&nbsp;<\/p>\n\n\n\n<p>In December 2023, Trump-appointed federal District Court Judge R. Austin Huffaker Jr. dismissed that claim, calling citizens\u2019 arrest and jailing \u201cvery disturbing\u201d but ruling that the suit was ripe to be dismissed because Amwaste, the garbage company in question, and the city had not \u201creached an understanding\u201d to jointly deprive residents of their rights. The case is currently on appeal.&nbsp;<\/p>\n\n\n\n<p>It\u2019s not clear what role, if any, the private company contracted to provide Chickasaw\u2019s trash services has played in that city\u2019s criminalization of unpaid garbage fees. A-1 McDuffie Sanitation, the firm, did not reply to requests for comment.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image size-large\"><img decoding=\"async\" width=\"1024\" height=\"683\" src=\"https:\/\/insideclimatenews.org\/wp-content\/uploads\/2024\/09\/Chickasaw-6_Credit-Lee-Hedgepeth-1024x683.jpg\" alt=\"McDuffie Sanitation is contracted to provide garbage services in Chickasaw. They\u2019re holding it hostage.\u201d&nbsp;<\/p>\n\n\n\n<p>Lowell initially tried to burn her trash but abandoned the effort when she felt that the resulting fumes were toxic.&nbsp;<\/p>\n\n\n\n<p>Now her neighbors are allowing her to place trash in their can when there\u2019s space.&nbsp;<\/p>\n\n\n\n<p>Lowell said the city\u2019s policy of making criminals out of those who\u2019ve fallen behind on their utility bills is immoral and unfair.&nbsp;<\/p>\n\n\n\n<p>\u201cThis is a place with a lot of older people. Good people.
